General Terms & Conditions & Website Terms Of Use

1. Legal Relationship with Clients

All legal relationships between OB Coaching & Consulting CommV, a Limited Partnership with company/VAT number: 0778.335.423 RPR Bruges, and registered office at Schoolstraat 115A – box 11, 8800 Beveren (Roeselare), Belgium (hereinafter referred to as “we”), and the client are governed by these terms and conditions. 2. Privacy

The client gives Oiheba permission to include their data in her client database. Oiheba strives to protect personal data as best as possible in accordance with applicable privacy legislation. Reference is made to the privacy policy, which can be consulted via the homepage of www.obcoaching.be and is considered an integral part of these terms and conditions.

3. Intellectual Property

Oiheba retains copyright and other intellectual property rights on all documents (including notes) and materials (such as an online webinar) created by her, regardless of whether charges were made to the client. The client is allowed to use and review the delivered materials solely to achieve the intended outcome. These rights are granted on a non-exclusive and non-transferable basis. Creating recordings (photo, video) of part or all of a workshop, course, or book presentation/lecture is not permitted. The client is not entitled to make any course, workshop, training, or educational material public, nor to share it with or transfer it to third parties.

Oiheba reserves the right to use sent or developed materials for promotional or informational purposes, such as, but not limited to, publication on a website, blog, or Facebook page, without owing any compensation to the client. Such information will always be published without mentioning the client’s name.

Oiheba explicitly retains all intellectual property rights, including copyrights, on all content (text, images, etc.) of this website. This content may not be reproduced or shared without prior written consent. Some images may be owned by third parties, for which Oiheba holds a user license in accordance with granted rights.

4. Website Usage Terms

These Terms of Use are provided by Oiheba Bensaâd, located at Schoolstraat 115A – box 11, 8800 Beveren (Roeselare), Belgium, with company/VAT number 0778.335.423, hereinafter referred to as ‘OB Coaching & Consulting CommV’. By using this website, you agree to these Terms of Use.

Oiheba strives to keep the content and information on this website up to date and accurate. However, the content (texts, images, etc.) is intended for general informational purposes only. Therefore, Oiheba expressly excludes any liability for errors or omissions in the provided content and information. For example, Caparzo Webdesign does not guarantee the suitability or relevance of the information for specific cases.

Oiheba aims to ensure the proper functioning of all website features. However, she cannot guarantee that the website is free from viruses or other technical issues. Access to (parts of) the website may be restricted or suspended at any time, whether for maintenance or any other reason.

Oiheba reserves the right to modify these terms and conditions at any time. These terms and conditions were last updated on July 12, 2025. Ongoing agreements remain subject to the terms and conditions that were valid at the time the agreement was concluded, unless otherwise agreed.

These Terms of Use are governed by Belgian law. Any disputes shall be handled by the courts of the district in which Oiheba’s registered office is located.

6. Provisions Concerning Individual and Group Trajectories

6.1 General Terms

Individual trajectories are governed by these terms and are provided no later than upon submission of the action plan and offer. Group trajectory terms are provided with the invitation to register. In case of conflict, the terms in the invitation or action plan prevail.

6.2 Pricing

Individual trajectory: Begins with a free intake. Prices are VAT inclusive for private clients. Sessions are charged per bundle (6, 9, or 12). Group trajectory: Fixed number of sessions at a total fixed rate.

6.3 Offer/Invitation

Individual: Offers valid for 14 days unless otherwise stated. Group: Invitations valid for 5 calendar days or fewer.

6.4 Agreement Formation

Individual: Agreement after intake confirmation and written acceptance. Group: Agreement after payment receipt.

6.5 Professionalism and Subcontractors

Oiheba delivers services professionally and may involve subcontractors with written approval.

6.6 Confidentiality

All parties involved are required to uphold confidentiality.

6.7 Client Cooperation

Client is responsible for timely and complete information provision.

6.8 Cancellation Policy

Individual: Cancellations up to 7 days = 10% fee. Within 7 days = full session cost. Group: Up to 14 days = full refund. Within 14 days = €50 fee.

6.9 Payment

Invoices payable within 14 days. Disputes must be reported in writing within 7 days. Interest and fees apply for late payments.

6.10 Acceptance of Assignment

Work is accepted if no remarks are received within 7 days of the last session.

6.11 Suspension/Termination

Either party may terminate in case of breach or insolvency. Agreement ends upon death of a party.

6.12 Liability

Limited to 3x the invoiced amount, except in case of fraud, intent, death, or injury. No liability for indirect damage.

6.13 Visual Material

Images from sessions may be used for promotion unless client opts out.

7. Book Purchase Provisions

7.1 Agreement and Pricing

Prices are VAT inclusive. Contract forms upon payment. Invoice follows.

7.2 Shipping and Delivery

Costs borne by client. Delivery by BPost within 30 days. Refund possible if delay occurs.

7.3 Complaints

Must be reported in writing within 7 calendar days. Oiheba will respond within 14 days.

8. Event Provisions (Workshops, Webinars, Book Presentations)

8.1 Invitation

Valid only for the named person and for 5 days.

8.2 Agreement Formation

Formed upon payment. May include catering, location, etc. Webinar access waives withdrawal right.

8.3 Cancellation

Client may cancel within 14 days after payment, unless the event has started or webinar access was granted.

8.4 Professionalism and Subcontractors

Executed professionally. Subcontractors may be involved with consent.

8.5 Liability

Limited to 3x the invoiced amount. No limitation in case of intent, injury, or death.

8.6 Visual Material

Photos/videos may be taken and used unless consent is withdrawn.

9. Final Provisions

9.1 Force Majeure

Events such as illness, war, or power failure allow for suspension or termination of the agreement.

9.2 Severability

If a clause is invalid, the rest remain valid. Invalid clauses will be replaced in good faith.

9.3 Applicable Law and Jurisdiction

Belgian law applies. Disputes fall under the courts of the district of Oiheba’s registered office.
